Abstract
The aim of this paper is to explain the process of introduction of parents' right to choose a school into Belgian education system. School Pact in!958 introduced the right of the parents, the free school choice, into Belgian education system and addressed the obligations of the state in order to guarantee it. The obligations of the state were consisted of establishing non-denominational school and subsidizing equally both public and private schools. It undertook parents' choice between denominational school and nondenominational school. On other hand, the state did not have any responsibility to control the school choice system. Signed into law on May 29, 1959, this idea in the School Pact was applied to all levels of school education and became lasting element of Belgian educational system. The limited role of the state in school choice system was originated from the principal enshrined in the Constitution of Belgium in 1831, namely Freedom of education. This conception excluded governmental domination from Belgian education. Therefore, Belgian case of free school choice shows us both complexity and possibility of a state's guarantee of individual choice and coexistence of diverse values.
