Abstract
The purpose of this paper is to identify the function of the Public Employment Relations Board (PERB) in California by examining the provisions of the Educational Employment Relations Act (EERA) and the Regulations of Public Employment Relations Board newly adopted this year. The findings of this paper are as follows. It is provided for in the EERA that the PERB, which consists of five members appointed by the Governor with the advice and consent of the Senate, is one of administrative boards which are independent of any state agency. Therefore, the PERB is authorized to make regulations and decisions for the purpose of conducting the collective bargaining in the public sector including the public school. In other words, the PERB has the legislative and juridical power. This power of the PERB leads the board of education and teacher's organization to make a contract and result in providing better educational service for the public.
