| Abstract |
In Chinese academia, there has been a great deal of controversy regarding surrogacy, which has formed opposing views of pro-surrogacy and anti-surrogacy. From an ethical perspective, surrogacy is grossly unethical, and the law should prohibit it. China has adopted a regulatory model that completely bans surrogacy. This direction is the correct position. However, there are practical problems with the current regulatory policy, such as the low level of legislation and incomplete regulation. In the future, regulating surrogacy in China may seek to increase the legislative level, increase illegal costs, and intervene in criminal and civil law to regulate surrogacy.
