Toward a Lawsuit on the State Compensation for Eugenic Surgery: A Legal Opinion
Abstract
This legal opinion is in response to the decision of the Tokyo District Court on June 30, 2020 ruling in a eugenic surgery case. While I agree with the understanding of constitutional rights in the original judgment of this court, there are many problems with understanding the constitutional state compensation right, the period of exclusion under the Civil Code, and the illegality of legislative inaction. This article will explain them.
